OE “Delta Pharma – AL” sh.p.k : Në dokumentat e tenderit, loti 6 kërkon bar Trastuzumab Origjinator, ndërkohë që operatori ekonomik ka ofertuar për barin Ogivri (Trastuzumab - Powder for concentrate for solution for infusion x 150mg), i cili pas verifikimit në adresat zyrtare (website) të FDA (Food & Drug Administration) dhe EMA (European Medicines Agency). Rezulton që ky bar Ogivri (Trastuzumab - Powder for concentrate for solution for infusion x 150mg) është bar Biosimilar. Gjithashtu operatori ekonomik ka dërguar kërkesë në sistem duke u shprehur që ka shkruar gabimisht çmimin në euro, në vend të ekuivalentit në lekë dhe ka kërkuar marrjen parasysh te ofertës se re, ne kundërshtim me pikën 1 dhe 2 të nenit 53 (Shqyrtimi i ofertave) të Ligjit Nr.
