Ka pasur ankesa nga Aeot SHPK me objekt Shfuqizimin e vendimit te Komisionit te Vleresimit te
Ofertave per skualifikimin e ofertes se paraqitur nga AEOT SHPK Eshte skualifikuar operatori ekonomik i meposhtem: -“AEOT” sh.a, per arsye: Paraqet keto mangesi ne dokumentat e dorezuara ne SPE : a) Ne dokumentat standarte te tenderit te kapaciteti ekonomik dhe financiar ne piken 2.2.2 ku kerkohet qe operatori ekonomik eshte i detyruar te paraqes bilancet vjetore ne formen e kekrkuar nese eshte ne kushtet e nenit 41 shkronja c” të Ligjit nr. 1009/2009 Per audituesin ligjor. Operatori ekonomik “AEOT ” ndodhet ne kushtet e nenit 41 shkronja c” të Ligjit nr. 1009/2009 ku thuhet se:“Personat juridikë që detyrohen për auditimin ligjor të pasqyrave financiare detyrohen të kryejnë auditimin ligjor të pasqyrave financiare vjetore, përpara publikimit të tyre, nga ekspertë kontabël ose shoqëri audituese,ku bilancet e dy viteteve të njëpasnjëshme, nuk duhet të kenë raport negativ ndërmjet aktivit dhe pasivit ,pasi totali i aktiveve te tij e tejkalon shumen prej 50 milion lekesh dhe shuma e te ardhurave nga veprimtaria ekonomike (qarkullimi) i tij e tejkalone shumen prej 100 milione lekesh dhe ne SPE nuk ka paraqitur akt ekspertizene pasqyrave financjare nga eksperti kontabel i miratuar. b) Ne piken 2.4 te DST-se eshte kerkuar fletë analize ose raport testimi të lëshuar nga organe kompetente shtetërore ose private të akredituara, 3 muajt e fundit, për mallrat objekt prokurimi: Stabilizant, Asfaltobeton, Bitum dhe Binder”. Operatori ekonomik “AEOT” nuk ka paraqirut flete e analizes per produktin Stabilizant ,duke qene se ka lidhur kontrate qiraje me Shoqerine VLLEZERIT LLUPO shpk per prodhimin e materialeve inerte ,nuk ka nje fletë analize ose raport testimi nga laboratori per produktet e kekruara sipsa percaktimit ne kriteret e DST-se. |
