Ka pasur ankesa nga operatoret ekonomike "2 N” SHPK dhe BOE “ASI-2A CO” SHPK & 2 Z
Konstruksion” SHPK.Me ane te vendimit Nr. 2345/ 4 prot. date 22.11.2022 KPP ka vendosur: 1. Të mos pranojë ankesën e BOE ankimues “ASI-2A CO” SHPK & “2 Z Konstruksion” dhe ankesen operatorit ekonomik "2 N” SHPK. Jane skualifikuar operatoret ekonomike te meposhtem: 1.BOE ASI-2ACO Shpk & 2Z Shpk, per arsye: -Bazuar ne marreveshjen e bashkepunimit midis operatoreve dhe ne formularin e ofertes ku eshte bere ndarja e zerave ne preventiv. Operatori 2 Z merr persiper te kryej punime prishje, murature, suvatimi dhe veshje, dyer dhe dritare sipas pikes 2.3.5 te kriteret e vecanta te kualifikimit per punime murature operatori nuk ploteson numrin e punonjesve per ndertimin e ketij zeri punimi, pra nuk ka asnje murator te deklaruar. -Sipas pikes 2.3.5 tek kriteret e vecanta te kualifikimit per punime suvatimi nuk disponon asnje suvatues per kryerjen e ketij zeri punimi, po ashtu sipas pikes 2.3.7 nuk disponon pajisjen perkatese “Pompe suvatimi” sipas kritereve te percaktuara ne DST. -Sipas pikes 2.3.5 te kriteret e vecanta te kualifikimit per punime prishje nuk plotesoni numrin e punonjesve qe nevojiten per kryerjen e ketij zeri punimi, sipas formularit deklaronvetem 2 punetor te thjeshte. -Operatori ASI-2A CO ka marre persiper te kryeje pjesen tjeter te punimeve si punime ndertimi, sistemim i jashtem. Sipas pikes 2.3.7 te kriteret e vecanta te kualifikimit mungon mjeti minieskavator i cili sherben per kryerjen e punimeve te marra persiper. 2. 2N shpk, per arsye: -skualifikohet pasi nga verifikimi rezulton se ne formularin e ofertes, oferta totale pa Tvsh eshte 69,974,257 leke pa Tvsh , kurse vlera e ofertes se deklaruar ne preventivin e ofertes eshte 69,976,257.33 leke pa Tvsh.Gjithashtu pas verifikimit te preventivit te ofertes ku jane analizuar te gjithe zerat e punimeve qe do te kryhen rezulton qe nuk ka gabime artimetike , si ne formularin e ofertes (ne tabelen permbledhese dhe ne vleren e deklaruar me shifra dhe fjale ,ashtu dhe ne preventivin e zerave te punimeve) ,vlere kjo referuese dhe thelbesore per klasifikimin dhe renditjen e operatoreve ne proceduren e prokurimit publik.Per sa me siper Oferta juaj refuzohet pasi ka mosperputhje midis vleres se deklaruar ne formularin e ofertes dhe vleres te deklaruar ne preventivin e ofertes. 3.GLAVENICA” Shpk, per arsye: -mungojne 1(nje) inxhinier hidroteknik dhe 1 (nje) arkitekt -nuk ploteson piken 2.3.4 (pika c) te Kriteret e vecanta te kualifikimit, ju mungon 1(nje) koordinator per sigurine dhe mbrojtjen e shendetit ne pune -nuk ploteson piken 2.3.5 (pika d) te Kriteret e vecanta te kualifikimit, ju mungon 1 (nje) saldator - nuk ploteson piken 2.3.8 te Kriteret e vecanta te kualifikimit, ju mungon licensa profesionale nga QKL Kodi III.2.B 4.“Viante Konstruksion” Shpk , per arsye: -nuk ploteson piken 2.3.4 (pika d) te Kriteret e vecanta te kualifikimit, ju mungojne 3(tre) punonjes per punime ne lartesi -nuk ploteson piken 2.3.5 (pika a) te Kriteret e vecanta te kualifikimit, ju mungojne 2 (dy) teknik ndertimi -nuk ploteson piken 2.3.7 te Kriteret e vecanta te kualifikimit, ju mungon 1 (nje) vibrator betoni. |
